eIDAS : Electronic Identification, Authentication and Trust Services

When talking about electronic signatures, it is important to mention the regulation applied in Europe (eIDAS). This is a European regulation that applies to all Member States regarding electronic identification and all trust services to secure electronic transactions in the internal market. This standard defines how states should organize the supervision of qualified service providers.

Today, this goes beyond the European framework, as other countries have implemented legal frameworks compatible with eIDAS to allow the exchange of documents while maintaining the same legal value. This is a true innovation of the European regulation.

Trusted List

The Trusted List is a list of all signature issuers (such as the Belgian state, the Luxembourg state, Luxtrust, etc.) monitored, listed by country, and the dates on which they are monitored. This list includes the various service providers on the market but not the tools that use these services, such as Rsign, Docusign, etc.

Electronic signatures come in several versions, each with its advantages depending on your needs.

Simple signature

This forms the basis for all electronic signatures. Its main action is to verify the user’s intention to sign with:

  • The name at the end of an email.
  • A scanned signature in a PDF.
  • A checkbox “I accept.”

Advanced Electronic Signature

This solution uniquely identifies the signer. The signer will create their signature using a method that only they control (smartphone, token, etc.), allowing for optimal security in data management. The document thus signed cannot be modified without invalidating the signature.

Non-qualified signature services can be integrated into the Trusted List, but the signature must be supplemented with a system of evidence.

 

Qualified Electronic Signature

The qualified electronic signature (QES) offers the highest legal guarantee for digital signatures. It has the same legal power as a handwritten signature and does not require additional evidence. However, signatories must use a qualified digital identity certificate issued by a trusted service provider supervised by the European Union.

Properly qualified and having undergone an accreditation and supervision process defined in the eIDAS regulation, this solution covers security, user verification processes, and protection of the signer’s key. Qualified signature services must be listed in the Trusted List.

Dealing with disputes

If there were to be a problem with the signature of a document in the case of a simple signature, you would need to provide, in addition to the signature, proof of the signatory’s identity, the agreed terms, the date of the signature, and the signatory’s intention to sign the document.

With an advanced signature, you have proof of the agreed terms and the date of the signature.

However, for a qualified signature, no additional proof is needed. If a document were to be signed but the recipient does not recognize themselves as the author, it would be up to the recipient to provide the proof.

What Electronic Signatures Cannot Do

Electronic signatures are not a KYC (Know Your Customer) tool. For example, you generally cannot know the nationality or country of residence of the recipient. It also cannot separate homonyms or verify that the signer has understood the terms.

You also cannot verify the signing powers of each of the recipients unless there is local regulation in place.
